Mediation/ADR

Experienced Colorado Springs Mediation Attorney

The vast majority of clients want to settle a dispute and avoid the stresses of litigation. Many parties are able to reach mediated agreements that fully resolve their legal cases, thus saving the expense, time, and overall emotional toll of court trials. If a client wants to avoid the unpredictable nature of a trial, we encourage them to attempt mediation and other forms of alternative dispute resolution (ADR) as a means of resolving difficult legal issues. ADR is a way for clients to amicably resolve a variety of family law and divorce related issues including:

If you have any questions about alternative dispute resolution, contact an experienced mediation lawyer at the law offices of Lynn Landis-Brown for a consultation and case evaluation.

Mediation

Out of court settlement through mediation is a good way to avoid intensifying the conflict involved in a divorce. Mediation is a voluntary process in which a neutral third party (the mediator) works with both parties to achieve a result both parties can live with. A mediator can help both parties accept that there is going to be an equitable division of property and debt and an allocation of parental responsibilities based on the best interests of the children, whether there is a prolonged court battle or not. Conflict is often the most damaging aspect of traditional divorce proceedings. We have seen too many families have to pick up the pieces after a bitter divorce contest. At the law offices of Lynn Landis-Brown, we care about the future of our clients. We strive to help our clients reach efficient resolutions while minimizing the conflict involved.

Divorce meditation also allows clients to maintain more control over the outcome of their divorce. Today's congested court system does not allow for the personal attention that divorce matters require. Too often, divorce litigation will result in a standard, one size fits all solution. At our law firm, we are committed to helping clients develop a customized and effective divorce settlement that is tailored to their unique situation.

Collaborative divorce law

Collaborative family law is a dispute resolution method whereby the attorneys for both of the parties to a family dispute agree to assist them in resolving conflict using cooperative strategies rather than adversarial techniques and litigation. This method encourages compassion and respect for all participants in the process, and advocates forgiveness, honest personal growth and personal responsibility. The Collaborative process is conducted by attorney “coaches” in informal surroundings. There is a promise that neither party will go to court to fight about the issues. The parties make a commitment to work though issues based upon not what is best for them, but what is best for the entire family. Trained attorneys bring their experience and creative ideas to the table to help the parties find solutions. Joint financial experts and mental health/child specialists are added to the team, if needed. As a collaborative law attorney our job is to help our clients reach a reasonable settlement.
